Acceptable Use Policy
This Acceptable Use Policy sets out how Beliq may be used. Under Section 1.1 of the Terms of Service it forms part of the contract, and under Section 1 of the Terms for Free Offerings it also applies to the invoice generator and the API playground. This is a translation of the German Nutzungsrichtlinie, which is the original and the binding version (see Section 9).
1. Purpose
Beliq generates and validates electronic invoices. This policy keeps the service secure, reliable and equally usable for everyone. We word it as concretely as we can, so that everyone can tell in advance what is permitted.
2. Prohibited content
You may not submit content that
- breaches applicable law, in particular copyright and trademark law, data protection law, tax law or competition law,
- is intended to create forged, falsified or misleading invoices or other financial documents,
- contains malware or code designed to disrupt or damage systems or to gain unauthorized access to them,
- is intended for phishing, fraud, impersonation or comparable deception,
- infringes third-party rights, in particular by publishing personal data without a legal basis.
3. Prohibited activities
You may not
- use the service in a way that disrupts or impairs its availability, performance or functionality for other users,
- circumvent authentication, rate limits, quotas, the abuse protection of the free offerings or other technical restrictions,
- access or attempt to access accounts, data or systems that are not yours,
- reverse engineer, decompile or disassemble the service, except where Sections 69d and 69e UrhG permit it,
- resell, sublicense or transfer the service to third parties without our consent in text form (Section 5.1 of the Terms of Service),
- create several accounts to circumvent quotas or plan limits,
- scrape or extract data from the service by automated means beyond the intended API usage,
- deliberately trigger error conditions at scale or exploit bugs for your own benefit.
4. Rate limits and fair use
Requests are subject to a per-minute rate limit and a monthly document quota according to your plan. You undertake to
- stay within the limits of your plan,
- respond to an HTTP 429 status by retrying with exponential backoff,
- not send excessively large requests designed to tie up a disproportionate amount of resources.
5. Security
You are responsible for the security of your API keys and credentials. You
- keep API keys confidential and do not place them in client-side code or in public repositories,
- rotate keys as soon as you suspect they have been compromised,
- do not run security or penetration tests or vulnerability scans against our infrastructure without our prior consent in text form,
- report vulnerabilities to the address named in our security.txt before publishing them.
6. Reporting violations
Please report violations of this policy to hello@beliq.eu. We follow up on reports without undue delay.
7. Enforcement
In the event of a violation we choose the measure that ends the violation and burdens you least. In this order, these are:
- a notice asking you to stop the violation,
- a temporary restriction of the affected feature or a lowering of the rate limit,
- suspension of access under Section 12.4 of the Terms of Service,
- termination for cause under Section 12.3 of the Terms of Service.
Before suspending or terminating we give you a reasonable period to put things right. That does not apply where the violation poses an immediate risk to the security or operation of the service or to third-party rights, or where a legal provision requires us to act immediately; in those cases we inform you immediately afterwards. We lift a suspension as soon as its cause no longer applies. We may report a violation to law enforcement authorities where there is concrete cause to do so.
8. Changes to this policy
This policy forms part of the contract, so Section 13 of the Terms of Service governs changes to it: at least 30 days' notice in text form, a pointer to the deadline and the right to object, and a right of objection for the customer. This policy contains no separate right for us to amend it.
9. Language version
This policy was drafted in German. This English version is for information only; in the event of discrepancies the German version prevails.
